What the public record says

Australia permits altruistic surrogacy but the gestational-carrier pathway is state or territory specific. In the curated New South Wales, Queensland, and Victoria options, legal-at-birth presumptions apply, commercial payment is prohibited, counselling and legal steps precede treatment, medical autonomy remains with the carrier, and parentage transfers only by a post-birth court order. Victoria additionally requires Patient Review Panel approval for registered ART, prohibits public surrogacy advertising, and does not make a written agreement a universal prerequisite.
